Terms of Service
These terms are an agreement between you and Qirai Technologies (3-101-960370 Sociedad Anónima) ("we", "us") about your use of Tiny Dungeon (the "Game"). By installing or playing the Game you accept them. If you do not accept them, please do not play.
1. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial use.
You agree not to:
- copy, sell, rent or redistribute the Game;
- reverse engineer, modify or tamper with it, except where that right cannot be excluded by law;
- use cheats, automation, or modified clients to alter progress, currency or purchases;
- interfere with our servers, or attempt to obtain currency or content you have not earned or paid for.
2. Your save
The Game creates an anonymous save on first launch. There is no sign-in, so the save belongs to the installation rather than to a person. If you delete the Game, reset your device, or move to a new one, your progress and any unspent currency may be lost and we may be unable to recover it.
3. Gold and gems
The Game contains two virtual currencies. Gold is earned by clearing rooms and can also be exchanged for gems. Gems can be bought with money.
Both are licensed to you, not owned by you. In particular:
- they have no monetary value and cannot be exchanged for money, goods, or anything outside the Game;
- they cannot be transferred to another player or another save;
- we may change the price of items, the amount an item grants, or the rate rooms pay, for future transactions — we will not retroactively take away currency you have already earned or bought;
- they may be lost if your save is lost, and they end if the Game is discontinued (see section 7).
Your balances are held on our servers, which are the authoritative record. Where a device disagrees with the server, the server's figure applies.
4. Purchases and refunds
Gems are sold as consumable in-app purchases through the Apple App Store and Google Play. Those stores process the payment, not us. The price you see is the price the store shows for your country and currency.
Gems are delivered once the store confirms the purchase and our servers have verified it. Each transaction is recorded so it can only pay out once.
Refunds are handled by the store you bought from. Apple and Google each have their own refund process and their decision is final as to the payment. Where you have a statutory right of withdrawal, note that by buying a consumable that is delivered immediately you may be asked to agree that delivery begins at once, which can end that right — the store will tell you at the time.
If a purchase is refunded or charged back, we may remove the corresponding gems, and any content bought with them, from your save.
If you paid and did not receive what you paid for, contact support@qirai.tech and we will put it right.
5. Availability
The Game plays offline. Some features — saving to our servers, buying gems — need a connection and our servers to be running. We do not promise the Game or those services will be uninterrupted or error-free, and we may change, suspend or withdraw features.
6. Our content
The Game, its artwork, rooms, characters, code and name are owned by us or our licensors and are protected by copyright and other rights. Third-party components are listed on the credits page under their own licences.
7. Ending this agreement
You may stop at any time by deleting the Game. We may suspend or end your access if you materially breach these terms — for example by cheating or attempting to obtain currency you have not paid for.
If we discontinue the Game we will give reasonable notice where we can. Virtual currency has no monetary value and is not refundable on discontinuation, except where the law requires otherwise.
8. Liability
The Game is provided "as is". To the fullest extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, or for lost progress or virtual currency.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all statutory rights, and nothing here affects them. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
9. Governing law
These terms are governed by the Laws of the Republic of Costa Rica. If you are a consumer, you may also rely on the mandatory consumer protections of the country you live in, and may bring proceedings there.
10. Changes
We may update these terms. The effective date at the top shows when they last changed, and continuing to play after a change means you accept the updated terms. If a change is material we will say so in the Game.
